TERMS AND CONDITIONS

All custom work clients will receive a copy of this agreement, which must be signed to begin services.

By purchasing a premade cover, you agree to these terms (includes premades purchased before completion).

SCHEDULING:
Premade Covers – are allotted to three within a week period. Once slots have been filled additional projects will be booked through to the next available slot.
Custom Covers – are booked on a two week schedule. Three custom cover projects are allowed within a two week period. Inquire about scheduling to verify your dates are available.
Rush Orders – are allotted to two within a week. These are subject for approval and aren’t guaranteed.
Additional Services – Are available on a first come, first served basis. There is no specific number allotted just inquire ahead to guarantee your project will be able to be completed by your deadline.


PAYMENTS

PREMADE COVERS:
Payment is due upon receipt of invoice (payment arrangements are not available for premade covers).

CUSTOM COVER PACKAGES/SERVICES DEPOSIT:
A non-refundable 30% down payment (unless a lower amount is agreed upon/a special promotion is going on) is due upon booking. Deposit is required to book your service or reserve your time slot.

PAYMENT PLANS:
Payment plans are available for custom packages. Plan arrangements will be discussed and once agreed upon by both parties a payment contract will need signed. Failure to meet the requirements of the payment contract, will result in termination of the agreement. No funds received will be refunded.

FINAL PAYMENT:
Final payment is due upon completion of the project. A 5% late fee will be added each week payment has not been received. Invoices not paid within 90 days will inquire a $50 fee. No files will be released until final payment has been received and processed.

RUSH ORDERS:
At this time rush orders are on a limit of two a week, a fee of $50 will be applied. Two week rush orders are subject to a $75 fee. One week rush orders will be subjected to a $100 additional fee. All rush orders have to be approved.

PREMADES:
Premade covers are available on a first come, first served basis. Once purchased, they aren’t sold again. Payment has to be paid in full upon receipt of invoice in order to claim your cover. All sales are final, refunds are not available under any circumstances.


PROJECT WORKFLOW – CUSTOM COVERS/SERVICES

INITIAL CONCEPT(S):
KJ Magical Designs, LLC will provide up to three concepts, unless a direction is already provided by the author.

REVISIONS:
Up to 10 revisions are included in the package. Each additional revision beyond the included 10 will be billed at an additional $10, up to three.

TURNAROUND TIME:
Average turnaround time is two weeks from the project start date. KJ Magical Designs, LLC is not responsible for missed deadlines due to additional changes or long response times from client.

KJ Magical Designs, LLC reserves the right to lengthen the deadline depending on family or special circumstances beyond anyones control.


PROJECT WORKFLOW – BASIC TO PREMIUM/DELUXE PREMADES

REVISIONS:
Basic Premades are subject to the basic changes of title, sub-title/series/tagline and author name changes. Color is an additional free revision change upon request. Hard revisions are subject to a $10 fee each (upgrade to premium to get three hard revisions included in price).

Premium/Deluxe Premades get all the basic changes as the basic cover. This option gives you access to three hard revisions. Additional will be charged $10 each.

FINAL APPROVAL:
Any changes requested after final approval and/or after final files have been sent will be billed an additional $30 per hour with a one-hour minimum fee.

PRICING:
Prices are subject to change at anytime, without warning. Price is guaranteed once contract is signed and deposit has been received. Future series/bulk orders may be grandfathered in at previous prices at the sole discretion of KJ Magical Designs, LLC.

FINAL FILES:
Files will be sent by email or through Facebook messenger.

PUBLISHING RIGHTS
Client represents and warrants that the text and materials provided by Client for the book cover design project are owned or licensed by Client and that Client is authorized to use and display such items in a book cover design. Client shall be solely responsible for the materials and the validity of copyrights, trademarks, and ownership claimed by client. Client agrees to indemnify and hold the Designers and their affiliates harmless from and against any claim of infringement, or any trademark, copyright or trade secret, or negligence arising from any of the text and materials provided by client.

Client agrees to abide by the terms of any license agreement by the terms of any license agreement for any images purchased by KJ Magical Designs, LLC through any third-party provided for use in final design.

OWNERSHIP RIGHTS
Upon receipt of full payment, KJ Magical Designs, LLC grants the client the exclusive license to use the final cover design artwork for his/her book cover and associated promotional materials. KJ Magical Designs, LLC maintains full copyright of all designs and draft concepts (including layout, style, image placement and fonts) and may not be recreated by anyone, nor can any works be based on the original design.

KJ Magical Designs, LLC always retains the right to use the final design, author name and book title in their portfolio and to market and promote services.

The client understands that the design may not be altered by anyone other than Kathryn (Katie) Jenkins or Alfredo Pachicano of KJ Magical Designs, LLC.

Raw layered files or blank files (graphic images lacking text) will not be provided to client due to copyright issues. PDF, JPG and/or other publishing-ready file(s) will be provided.

ATTRIBUTION
KJ Magical Designs, LLC requires cover design credit to appear in client’s book on the copyright page as: “Cover design © Kathryn Jenkins of kjmagicaldesigns.com” as well as in a small, unobtrusive line on the back cover.
If certain items require an attribution by the creator or site material used to create the final cover you will be notified by KJ Magical Designs, LLC (this is more for premades).

CLIENT RESPONSIBILITY
Client is fully responsible for proofing the book cover design provided by the Designers and it is strongly suggested that Client requests a proof from the printer before publishing or ordering any copies of the book.

LIABILITY
At no time will Designers be held financially or legally responsible for any problems, costs, fees or expenses incurred by Client as a result of using the book cover design provided by Designers.

While Designers will do their best to fix any problems that may arise with the book cover design, they cannot be held responsible for any costs, fees, or expenses due to any problem with the book cover design.

AGREEMENT
This agreement is the entire agreement of all parties. No additional promises or conditions, written or oral, apply to this agreement that are not included herein.
